These Terms of Service ("Terms") govern your access to and use of Listing Falcon ("Listing Falcon," "we," "us," or "our"), a web application that helps real estate professionals turn listing photos into marketing ads and short walkthrough videos. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
You must be at least 18 years old and able to form a binding contract to use Listing Falcon. You are responsible for the accuracy of the information you provide and for all activity that occurs under your account. Keep your login credentials confidential and notify us promptly of any unauthorized use. You are responsible for ensuring you have the legal right to market any property whose photos or details you upload.
Listing Falcon lets you upload listing photos and details and generate marketing assets, including image ads sized for various platforms and short "Ken Burns" style walkthrough videos with optional AI-generated voiceover. The service may also store your created assets in a cloud library and generate public share pages for assets you choose to make public. Features, limits, and availability may change over time, and some features are limited to specific paid plans.
"Your Content" means the photos, text, property details, brand information, logos, and other materials you upload or input. You retain all ownership rights in Your Content. By using the service, you grant Listing Falcon a limited, non-exclusive, worldwide license to host, process, reproduce, and transform Your Content solely to operate and provide the service to you (for example, to render an ad or video, store it in your library, and serve a public share page you enable).
You represent and warrant that you own or have the necessary rights, licenses, and permissions to Your Content and to the properties it depicts, and that your use of the service does not violate any third party's rights (including copyright, trademark, privacy, or publicity rights) or any listing agreement, MLS rule, or law.
Some output is produced using third-party artificial intelligence models (for example, text-to-speech voiceover and optional image enhancement). AI output may contain inaccuracies and is provided for your review. You are solely responsible for reviewing all generated content before publishing or distributing it, including for accuracy of property details, compliance with fair housing and advertising laws, and any required disclosures. You should not rely on generated narration or copy as legally accurate descriptions of a property.

Listing Falcon offers a free tier and one or more paid subscription plans. Paid plans are billed in advance on a recurring basis (for example, monthly) through our payment processor, Stripe. By starting a paid plan, you authorize us and Stripe to charge your payment method on each renewal at the then-current price until you cancel. Prices may change; we will give reasonable notice of any price change before it applies to you. You are responsible for any applicable taxes.
You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and you will retain paid access until then. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused features. If you believe you were charged in error, contact us and we will review in good faith.
The service, including its software, design, templates, and the Listing Falcon name and logo, is owned by Listing Falcon and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms. We retain all rights not expressly granted.
The service relies on third-party providers to function, including cloud hosting and database providers, AI model providers, and a payment processor. Your use of the service may be subject to those providers' terms, and we are not responsible for their acts or omissions. See our Privacy Policy for how data is shared with these providers.
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that generated content will be accurate or suitable for any particular use. Listing Falcon is a content-creation tool and does not provide legal, real estate, or compliance advice.
To the maximum extent permitted by law, Listing Falcon and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim arising out of or relating to the service will not exceed the greater of (a) the amounts you paid us in the twelve months before the event giving rise to the claim, or (b) US $100.
You agree to indemnify and hold harmless Listing Falcon and its owners from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the service, or your violation of these Terms or any law or third-party right.
You may stop using the service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Upon termination, your right to use the service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, unless applicable law requires otherwise.
